Court asks PDP national chair to vacate office 
 
A High Court of the Federal Capital Territory (FCT) yesterday ordered the Acting National Chairman of the Peoples Democratic Party (PDP), Chief Uche Secondus, to vacate the office within 14 days.Justice Hussein Baba handed down the order while ruling on the suit filed by former Special Adviser to former President Goodluck Jonathan of political matter, Ahmed Gulak.
 
He held that Secondus was occupying the position of the Acting National Chairman of the PDP illegally.But shortly after the judgement was delivered, the counsel to the PDP in the matter, Mr. Paul Isaiah, said the party would appeal the judgement of the court.Mr Isaiah said a stay of execution of the judgement would also be filed.
 
“We are going to appeal this judgement. Apart from the appeal, we are also going to file a stay of execution of the judgement because the National Convention of the party is in March next year,” he said.
The court, in its judgement, held that the position of the Acting National Chairman of the party is zoned to the North-East.
It, therefore, stated that the position could not be occupied by Chief Secondus.
He ordered that Chief Secondus should vacate the office within 14 days and said that the plaintiff or any other party member worthy of that position should assume the position of the Acting National Chairman of the party.
 
On November 30, 2015, the court reserved its judgment in the suit.
In the suit, Gulak is seeking the sack of the party’s Acting National Chairman, Secondus , on the ground that by the provision of  the PDP constitution and its zoning principle, he was the proper person to replace the last Chairman, Adamu Muazu, who hailed from the Northeast geopolitical zone.
Parties to the suit had argued the plaintiff’s substantive suit (originating summons) and the defendants’ preliminary objection and adopted their final written addresses, before the judge told them that hearing notices will be issued when the judgment is ready.
Arguing his client’s case, plaintiff’s lawyer, Jibrin Okutepa (SAN), urged the court to uphold Gulak’s prayers and refuse the preliminary objection raised against the suit by the defendants - the PDP and Secondus.
